TERMS AND CONDITIONS
§ 1 Scope
(1) The following General Terms and Conditions in the version valid at the time of the order shall apply exclusively to the legal relationships established via this online shop (including the app) between World of Efoil GmbH and its customers.
(2) Deviating general terms and conditions of the customer are rejected.
§ 2 Conclusion of the Contract
(1) The presentation of the products in the online shop does not constitute a legally binding offer, but only an invitation to order.
(2) By clicking the button (Buy/order with obligation to pay), you place a binding order for the selected goods.
(3) The purchase contract is concluded when you personalize and order the products on worldofefoil.de and World of Efoil GmbH accepts your order by sending an order confirmation by email immediately after receiving your order.
§ 3 Products
(1) The buyer can obtain information about the essential characteristics of the products by clicking on the detailed product sheet on the website. In the event of a product defect, the buyer will be informed in the email confirming their order and acknowledges that World of Efoil GmbH has the right to cancel the order. World of Efoil GmbH has the right to change the offer of products for sale on the website at any time.
(2) The materials used in our raw materials and manufacturing processes may change over time, e.g., in colors when exposed to sunlight.
§ 4 Obligations of the Orderer
(1) Please refer to our privacy policy in this context.
§ 5 Prices and Payment
(1) The prices stated on the website at the time of the order are valid.
(2) The order value becomes due for payment upon confirmation of the order. Payment is made online, e.g., by Paypal. Payment of the purchase price must be made immediately upon receipt of the order confirmation without any deductions, or otherwise agreed on in written.
(3) Production will only begin once you have made the full payment; this may result in corresponding shipping delays.
(4) The ordered products remain the property of World of Efoil GmbH until full payment has been made.
(5) In the event of chargebacks by your bank, the further processing of the transaction may be handed over to a partner company. All incurred chargeback fees, default interest, and all external costs such as attorney fees will be charged to the orderer.
§ 6 Shipping
(1) Shipping will be made after receipt of payment and production to the specified shipping address. The currently possible delivery countries will be visible when entering the delivery address in the app. After dispatch, you will receive a confirmation email from us. The delivery time is usually about 3-10 working days, depending on the delivery country and production location. Longer delivery times will be communicated to you on a case-by-case basis.

(2) Standard deliveries are made at the shipping costs stated on the website. Shipping costs may vary depending on the product and delivery country.
(3) All other shipping costs, such as for express deliveries, must be agreed upon with World of Efoil GmbH by phone or email.
(4) The occurrence of a delivery delay by World of Efoil GmbH is determined by the statutory provisions, with the proviso that in any case, a reminder by you is required and the subsequent delivery period must be at least 14 days.
In addition, due to the worldwide spread of the coronavirus and its impact on production facilities and freight traffic, there may be further significant delivery delays and correspondingly longer delivery times.
(5) If the ordered products cannot be delivered for reasons not attributable to World of Efoil GmbH, World of Efoil GmbH is entitled to withdraw from the purchase contract in whole or in part and to refund any payments already received from you accordingly.
(6) World of Efoil GmbH is entitled to make partial deliveries and partial services at any time.
(7) If you do not accept the delivered goods, World of Efoil GmbH has the right to withdraw from the order or claim damages for non-performance after the fruitless expiry of a set grace period of two weeks.
§ 7 Warranty for Defects
(1) A warranty case does not exist if the ordered products were produced and manufactured according to the specifications of the orderer. Errors in products, which are based in particular on incorrect specifications or data, are the responsibility of the orderer.
(2) The risk of accidental loss and accidental deterioration of the goods as well as the risk of delay passes to the buyer upon delivery of the goods to the carrier, the freight forwarder, or the person or institution otherwise designated to carry out the shipment. For personalized products, the statutory provisions of the contract for work and services (contract for work and materials) apply.
(3) A warranty of any kind for delivered products beyond a possible statutory warranty exists only if this is expressly stated in the order confirmation for the respective products.
(4) Any defects must be reported to World of Efoil GmbH in writing by presenting the defective products to World of Efoil GmbH (e.g., by digital photos or return shipment).
§ 8 Right to Subsequent Delivery
(1) After the delivery period has expired, World of Efoil GmbH is entitled to a subsequent delivery period of a maximum of 20 days. After the expiry of the subsequent delivery period, the withdrawal from the contract is deemed to have taken place, excluding claims for damages.
(2) Fixed-date transactions are not made.
(3) In the case of justified complaints about defects, World of Efoil GmbH has the right to rectify the defect or deliver defect-free replacement goods within 20 days after receipt of the goods.
§ 9 Liability and Damages
(1) Claims for damages by you as the orderer are excluded. Excluded from this are claims for damages by the orderer arising from injury to life, body, or health or from the breach of essential contractual obligations (cardinal obligations) as well as liability for other damages based on an intentional or grossly negligent breach of duty by World of Efoil GmbH, its legal representatives, or vicarious agents.
(2) In the event of a breach of essential contractual obligations, World of Efoil GmbH is only liable for the foreseeable damage typical for the contract if this was caused by simple negligence, unless it concerns claims for damages by the orderer arising from injury to life, body, or health.
(3) The limitations of paragraphs (1) and (2) also apply in favor of the legal representatives and vicarious agents of World of Efoil GmbH if claims are asserted directly against them.
(4) The provisions of the Product Liability Act remain unaffected.
§ 10 Right of Withdrawal
(for non-personalized products)
(1) You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods. Excepted Gift cards and E-foil Courses
(2) To exercise your right of withdrawal, you must inform us (World of Efoil GmbH, [your address], phone: [your phone number], email: [your email address]) by means of a clear statement (e.g., a letter sent by post or email) of your decision to withdraw from this contract.
(3) To meet the withdrawal deadline, it is sufficient for you to send the communication regarding your exercise of the right of withdrawal before the withdrawal period has expired.
§ 11 Consequences of Withdrawal
(1) If you withdraw from this contract, World of Efoil GmbH must refund all payments received from you, including shipping costs (except for other shipping costs), without delay and at the latest within fourteen days from the day on which the notification of your withdrawal from this contract was received by World of Efoil GmbH.
(2) For this refund, World of Efoil GmbH will use the same means of payment that you used for the original transaction (unless expressly agreed otherwise with you; in no case will World of Efoil GmbH charge you any fees for this refund).
(3) World of Efoil GmbH may refuse the refund until World of Efoil GmbH has received the goods back or until you have provided proof that you have returned the goods (whichever is earlier).
(4) You must return or hand over the products to World of Efoil GmbH without delay and in any case no later than fourteen days from the day on which you informed World of Efoil GmbH of the withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired. You bear the direct costs of returning the product.
(5) You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
§ 12 Exceptions to the Right of Withdrawal
(1) If you are an entrepreneur within the meaning of § 14 of the German Civil Code (BGB) and act in the exercise of your commercial or independent professional activity when concluding the contract, the right of withdrawal does not apply.
§ 13 Applicable Law
(1) Contracts between World of Efoil GmbH and you as the orderer are subject exclusively to the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. For disputes arising in connection with the order, German law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Syke, Germany.
(2) If individual provisions of these general terms and conditions and/or the contract supplemented by them are or become invalid, this shall not affect the validity of the other provisions, and the contract and these GTC shall remain effective for both parties.
§ 14 Location / Use of the AUDI e-tron Foils
On which waters can you ride an AUDI e-tron Foil? Please observe the legal regulations. Depending on the country and region, riding e-foils on the respective waters may be prohibited. It is the customer’s responsibility to familiarize themselves with the legal regulations before using the AUDI e-tron Foil. In case of doubt, contact the competent authorities directly. World of Efoil GmbH assumes no liability for any fines and damages resulting from the unauthorized use of an efoil.
Refund Overview
Our refund and returns policy lasts 14 days. If 14 days have passed since your purchase, we can’t offer you a full refund or exchange.
To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging.
Several types of goods are exempt from being returned. Perishable goods such as food, flowers, newspapers or magazines cannot be returned. We also do not accept products that are intimate or sanitary goods, hazardous materials, or flammable liquids or gases.

Refunds
Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.
If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days.
Late or missing refunds
If you haven’t received a refund yet, first check your bank account again.
Then contact your credit card company, it may take some time before your refund is officially posted.
Next contact your bank. There is often some processing time before a refund is posted.

Sale items
Only regular priced items may be refunded. Sale items cannot be refunded.
Exchanges
We only replace items if they are defective or damaged. If you need to exchange it for the same item, send us an email at {email address} and send your item to: {physical address}.
Gifts
If the item was marked as a gift when purchased and shipped directly to you, you’ll receive a gift credit for the value of your return. Once the returned item is received, a gift certificate will be mailed to you.
If the item wasn’t marked as a gift when purchased, or the gift giver had the order shipped to themselves to give to you later, we will send a refund to the gift giver and they will find out about your return.
Shipping returns
To return your product, you should mail your product to: World of Efoil GmbH, Wiesenstrasse 5, 27211 Bassum, Germany.
You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.
Depending on where you live, the time it may take for your exchanged product to reach you may vary.
If you are returning more expensive items, you may consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item.
